Acceptance of Terms

By accessing or using the Visard Gallery website (“the Site”) or purchasing artwork from Visard Gallery (“the Gallery”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site or make a purchase.

Eligibility

You represent that you are at least 18 years of age or have the consent of a legal guardian to use this Site and to enter into binding agreements.

Artwork Listings & Descriptions

All artworks are offered subject to prior sale. The Gallery makes reasonable efforts to accurately describe all works, including artist, medium, dimensions, and condition; however:

  • Descriptions and condition reports are opinions, not guarantees

  • Images may not be to scale or fully representative of color, texture, or surface detail

  • Minor imperfections, age-related wear, or variations are inherent to artwork

Buyers are encouraged to request additional information prior to purchase.

Pricing & Payment

All prices are listed in U.S. dollars unless otherwise stated.

  • Prices are subject to change without notice

  • Sales tax, VAT, customs duties, or import fees are the responsibility of the buyer

  • Payment must be received in full before artwork is released for shipment

The Gallery reserves the right to cancel any transaction due to errors, availability issues, or suspected fraud.

Shipping & Handling

Shipping, handling, packing, insurance, and crating fees are separate from artwork prices unless otherwise stated.

Certain artworks require custom shipping quotes based on size, value, destination, and insurance requirements. These costs may be invoiced separately and must be paid prior to shipment.

Visard Gallery is not responsible for carrier delays, customs processing times, or events beyond its control.

All Sales Final

All artwork sales are final unless otherwise expressly agreed in writing. Please refer to the Gallery’s Return & Reconsignment Policy for full details.

Intellectual Property & Image Rights

All content on the Site—including but not limited to images of artwork, photographs, text, logos, layout, and branding—is the exclusive property of Visard Gallery or used with permission.

  • Images of artworks on this Site are protected by copyright

  • Images may not be copied, reproduced, published, transmitted, or used for any purpose without prior written permission from Visard Gallery

  • When permission is granted, proper credit to Visard Gallery is required

  • Unauthorized use of images or content may result in legal action

Ownership of an artwork does not convey reproduction rights unless explicitly stated in writing.

Limitation of Liability

To the fullest extent permitted by law, Visard Gallery shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of value, loss of enjoyment, or investment-related claims

  • Errors or omissions in descriptions or images

The Gallery’s total liability shall not exceed the purchase price of the artwork.

Indemnification

You agree to indemnify and hold harmless Visard Gallery from any claims, damages, or expenses arising from:

  • Your misuse of the Site

  • Violation of these Terms

  • Unauthorized reproduction or use of images or content

Privacy

Use of the Site is also governed by our Privacy Policy, which outlines how personal information is collected and used.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the State in which Visard Gallery operates, without regard to conflict of law principles.

Modifications

Visard Gallery reserves the right to update or modify these Terms of Service at any time without prior notice. Continued use of the Site constitutes acceptance of any changes.
